{"id":715,"date":"2016-03-03T02:47:18","date_gmt":"2016-03-03T02:47:18","guid":{"rendered":"http:\/\/asiattorney.amagumolabs.io\/new-regulation-on-work-permit-for-foreigners-in-vietnam\/"},"modified":"2018-06-06T02:49:16","modified_gmt":"2018-06-06T02:49:16","slug":"new-regulation-on-work-permit-for-foreigners-in-vietnam","status":"publish","type":"post","link":"http:\/\/54.179.223.75\/fr\/new-regulation-on-work-permit-for-foreigners-in-vietnam\/","title":{"rendered":"Nouvelles r\u00e8gles concernant les permis de travail des \u00e9trangers au Vietnam"},"content":{"rendered":"<p>En g\u00e9n\u00e9ral, un \u00e9tranger qui souhaite travailler Vietnam pour une soci\u00e9t\u00e9 ou une organisation install\u00e9e dans le pays doit d&rsquo;abord obtenir un permis de travail ou bien un certificat d&rsquo;exemption de permis de travail d\u00e9livr\u00e9 par les autorit\u00e9s comp\u00e9tentes, aux termes du D\u00e9cret 102\/2013\/ND-CP d\u00e9taillant les conditions d&rsquo;application des dispositions du Code du travail relatives aux \u00e9trangers travaillant au Vietnam  (D\u00e9cret 102).<\/p>\n<p>Dans un but louable de clarification du r\u00e9gime juridique actuel, le D\u00e9cret 11\/2016\/ND-CP (D\u00e9cret 11) qui entre en vigueur le 1er avril 2016 apporte de nombreuses am\u00e9liorations \u00e0 la r\u00e9glementation sur les permis de travail, notamment concernant la d\u00e9finition des experts, managers, techniciens, mais \u00e9galement pour les exemptions de permis de travail et la proc\u00e9dure d\u2019obtention du permis de travail.<\/p>\n<p>A. Exemption de permis de travail lorsque le salari\u00e9 fait l\u2019objet d\u2019un transfert interne au sein du groupe \/ de la soci\u00e9t\u00e9<\/p>\n<p>1. Conditions applicables \u00e0 la soci\u00e9t\u00e9<\/p>\n<p>&#8211; Etre enregistr\u00e9e au Vietnam et op\u00e9rer parmi l\u2019un des 11 secteurs concern\u00e9s par les engagements du Vietnam \u00e0 l\u2019OMC.<\/p>\n<p>&#8211; Avoir un besoin reconnu de main d\u2019\u0153uvre \u00e9trang\u00e8re.<\/p>\n<p>2. Conditions applicables au salari\u00e9<\/p>\n<p>L\u2019employ\u00e9 doit avoir fait l\u2019objet d\u2019un recrutement par la soci\u00e9t\u00e9 au moins 12 moins avant son transfert.<\/p>\n<p>&#8211; Manager et Directeur ex\u00e9cutif \/ Directeur g\u00e9n\u00e9ral :<\/p>\n<p>Manager ou la personne qui occupe le poste de vice-manager, ou;<br \/>\nLe directeur ex\u00e9cutif doit \u00eatre la personne qui occupe le poste le plus \u00e9lev\u00e9 ou le directeur de la soci\u00e9t\u00e9 et diriger directement un d\u00e9partement de la soci\u00e9t\u00e9.<br \/>\n&#8211; Expert :<\/p>\n<p>Un \u00e9tranger reconnu comme tel par \u00e9crit par une soci\u00e9t\u00e9 ou une organisation \u00e9trang\u00e8re;<br \/>\nUn travailleur \u00e9tranger titulaire d\u2019un Master ou d\u2019un dipl\u00f4me plus \u00e9lev\u00e9 et au moins 3 ann\u00e9es d\u2019exp\u00e9rience (au lieu de 5 auparavant) dans le secteur de sa sp\u00e9cialit\u00e9 et pour lequel il va exercer au Vietnam.<br \/>\n&#8211; Technicien :<\/p>\n<p>Un \u00e9tranger qui a suivi une formation d\u2019une ann\u00e9e au moins dans son domaine de sp\u00e9cialit\u00e9 ainsi qu\u2019une exp\u00e9rience de trois ann\u00e9es dans ce domaine.<\/p>\n<p>La dur\u00e9e de validit\u00e9 de l\u2019exemption de permis de travail d\u00e9livr\u00e9e par les autorit\u00e9s est de deux ann\u00e9es.<\/p>\n<p>B. Un r\u00e9gime plus souple pour les missions de courte dur\u00e9e au Vietnam<\/p>\n<p>Le D\u00e9cret 11 pr\u00e9voit que l\u2019employeur n\u2019a  plus besoin d\u2019obtenir l\u2019accord du Comit\u00e9 populaire ni de faire une demande de reconnaissance du besoin en travailleur \u00e9tranger, dans les situations suivantes (non exhaustif):<\/p>\n<p>&#8211; Les \u00e9trangers qui viennent au Vietnam pour une dur\u00e9e de moins de 3 mois pour les besoins d\u2019une proposition de service ;<\/p>\n<p>&#8211; Les \u00e9trangers qui se rendent au Vietnam pour une dur\u00e9e inf\u00e9rieure \u00e0 3 mois dans le but de r\u00e9soudre un incident technique, technologique ou une situation complexe ayant une incidence sur la production, ne pouvant pas \u00eatre r\u00e9solue par des experts se trouvant au Vietnam, vietnamiens ou \u00e9trangers ;<\/p>\n<p>&#8211; Les \u00e9trangers qui se rendent au Vietnam pour exercer des fonctions de directeur g\u00e9n\u00e9ral, expert, technicien ou managers, pour moins de 30 jours ou sur une dur\u00e9e inf\u00e9rieure \u00e0 90 jours par an.<\/p>\n<p>C. Le permis de travail dans des situations atypiques : des pr\u00e9cisions bienvenues !<\/p>\n<p>Le D\u00e9cret 102 ne contenait pas de dispositions relatives \u00e0 certains cas sp\u00e9ciaux, rendant difficile la gestion de situations particuli\u00e8res. Le D\u00e9cret 11 donne plus de d\u00e9tails pour les situations dans lesquelles l\u2019\u00e9tranger a d\u00e9j\u00e0 un permis de travail mais change d\u2019employeur ou lorsqu\u2019il change de fonctions \u00e0 l\u2019int\u00e9rieur de la soci\u00e9t\u00e9.<\/p>\n<p>D. L\u00e9galisation ou authentification des documents fournis, proc\u00e9dure de demande<\/p>\n<p>L\u2019article 9 du D\u00e9cret 11 pr\u00e9voit la cr\u00e9ation et la tenue d\u2019une liste pr\u00e9cise de documents devant \u00eatre l\u00e9galis\u00e9s, \u00e0 l\u2019exception des cas o\u00f9 l\u2019exemption de l\u00e9galisation est acquise en vertu d\u2019un trait\u00e9 international ou lorsque la fourniture d\u2019une copie simple est possible.<\/p>\n<p>Le principe demeure n\u00e9anmoins celui d\u2019une l\u00e9galisation des pi\u00e8ces du dossier.<\/p>\n<p>La dur\u00e9e de validit\u00e9 de certaines pi\u00e8ces du dossier est \u00e9tendue. Ainsi, le certificat m\u00e9dical peut dater de 12 mois. Enfin, le d\u00e9lai de principe de traitement de la demande est raccourci de 10 \u00e0 7 jours en principe, une fois le dossier complet fourni \u00e0 l\u2019administration.<\/p>\n<p>E. Retrait du permis de travail<\/p>\n<p>Les conditions relatives au retrait du permis de travail sont pr\u00e9cis\u00e9es dans le D\u00e9cret 11 \u00e0 la diff\u00e9rence des lacunes que pr\u00e9sentait le D\u00e9cret 102.
