{"id":767,"date":"2015-09-21T03:41:29","date_gmt":"2015-09-21T03:41:29","guid":{"rendered":"http:\/\/asiattorney.amagumolabs.io\/buying-a-home-in-vietnam-at-which-conditions\/"},"modified":"2018-06-06T03:45:28","modified_gmt":"2018-06-06T03:45:28","slug":"buying-a-home-in-vietnam-at-which-conditions","status":"publish","type":"post","link":"http:\/\/54.179.223.75\/fr\/buying-a-home-in-vietnam-at-which-conditions\/","title":{"rendered":"Acheter un logement au Vietnam : \u00e0 quelles conditions ?"},"content":{"rendered":"<p>En cette rentr\u00e9e 2015, alors que les projets immobiliers d\u2019envergure se multiplient \u00e0 Saigon, la nouvelle loi sur le logement fait beaucoup parler d\u2019elle au sein de la communaut\u00e9 des expatri\u00e9s Les autorit\u00e9s, qui cherchent \u00e0 relancer un secteur sinistr\u00e9, souhaitent attirer les financements \u00e9trangers, que ce soit du c\u00f4t\u00e9 des promoteurs ou bien du c\u00f4t\u00e9 des acqu\u00e9reurs individuels.<\/p>\n<p>Quelles sont les nouveaut\u00e9s contenues dans la loi sur le logement vot\u00e9e le 25 novembre 2014 et entr\u00e9e en vigueur le 1er juillet 2015 ? Quels changements sont \u00e0 relever par rapport au pr\u00e9c\u00e9dent programme exp\u00e9rimental mis en place en 2008 concernant l\u2019acquisition de biens immobiliers au Vietnam par les \u00e9trangers ?<\/p>\n<p>Les deux grandes innovations \u00e0 saluer sont les suivantes :<\/p>\n<p>\u00b7         L\u2019absence de condition relative \u00e0 la dur\u00e9e du s\u00e9jour au Vietnam pour acqu\u00e9rir un bien immobilier au Vietnam, puisque d\u00e9sormais un visa touristique suffit \u00e0 conclure un contrat de vente (article 159.1.c, les fonctionnaires internationaux et personnels diplomatiques \u00e9tant express\u00e9ment exclus du b\u00e9n\u00e9fice de ces dispositions) ;<\/p>\n<p>\u00b7         L\u2019ouverture timide du droit d\u2019usage sur le sol aux \u00e9trangers, puisque les villas font d\u00e9sormais partie des biens \u00ab achetables \u00bb, terrain compris.<\/p>\n<p>Que peut-on acheter ?<\/p>\n<p>Attention toutefois, les \u00e9trangers ne peuvent pas acheter n\u2019importe quel bien au Vietnam. Pour pouvoir \u00eatre titr\u00e9 au nom d\u2019un \u00e9tranger, le bien concern\u00e9 doit obligatoirement faire partie d\u2019un \u00ab programme immobilier commercial \u00bb. Il peut donc s\u2019agir soit d\u2019une maison situ\u00e9e dans un lotissement ou bien d\u2019un appartement faisant partie d\u2019un immeuble en copropri\u00e9t\u00e9 (souvent appel\u00e9 \u00ab condominiums \u00bb). Ces projets immobiliers sont g\u00e9r\u00e9s par des promoteurs l\u00e9galement enregistr\u00e9s au Vietnam et qui disposent d\u2019un droit d\u2019usage global sur le sol du projet.<\/p>\n<p>Par cons\u00e9quent, l\u2019achat d\u2019un terrain \u00e0 b\u00e2tir ou d\u2019une maison coloniale de l\u2019\u00e9poque fran\u00e7aise est exclu pour un \u00e9tranger.<\/p>\n<p>Pour combien de temps ?<\/p>\n<p>La dur\u00e9e de d\u00e9tention varie selon que l\u2019on soit \u00e9tranger, d\u2019origine vietnamienne ou mari\u00e9(e) avec un conjoint de nationalit\u00e9 vietnamienne.<\/p>\n<p>Dans le premier cas, la dur\u00e9e d\u2019usage primaire sera de 50 ans, th\u00e9oriquement renouvelable une fois pour 50 ann\u00e9es suppl\u00e9mentaires. Dans l\u2019hypoth\u00e8se d\u2019un acqu\u00e9reur poss\u00e9dant des origines vietnamiennes (Viet-Kieu) ou d\u2019un \u00e9tranger mari\u00e9(e) avec une personne de nationalit\u00e9 vietnamienne, le droit d\u2019usage sera illimit\u00e9 dans le temps, comme pour les personnes de nationalit\u00e9 vietnamienne.<\/p>\n<p>Comment revendre ? Comment transmettre ?<\/p>\n<p>La revente du bien ne pose pas de probl\u00e8mes particuliers. Bien entendu, elle doit logiquement se faire pendant la dur\u00e9e l\u00e9gale du droit d\u2019usage. A d\u00e9faut, l\u2019Etat r\u00e9cup\u00e8rera le bien qui aurait \u00e9t\u00e9 abandonn\u00e9 par son propri\u00e9taire.<\/p>\n<p>En ce qui concerne la transmission par donation ou h\u00e9ritage, c\u2019est \u00e9galement possible. Tout comme pour la revente, le b\u00e9n\u00e9ficiaire du legs ou l\u2019h\u00e9ritier devra \u00eatre \u00e9ligible (passeport ordinaire et visa touristique vietnamien) au jour de l\u2019entr\u00e9e en possession du droit d\u2019usage pour \u00eatre reconnu et inscrit comme b\u00e9n\u00e9ficiaire par les autorit\u00e9s.<\/p>\n<p>Limites territoriales \u00e0 l\u2019acquisition<\/p>\n<p>Les autorit\u00e9s ne souhaitant pas voir se d\u00e9velopper des quartiers uniquement habit\u00e9s par des \u00e9trangers, une limite a \u00e9t\u00e9 pos\u00e9e \u00e0 la pr\u00e9sence d\u2019acqu\u00e9reurs non-vietnamiens par zone : cette limite est soit de 30% des unit\u00e9s d\u2019un immeuble r\u00e9sidentiel, soit 250 maisons au sein d\u2019un ensemble dont la population est \u00e9quivalente \u00e0 celle d\u2019un quartier (ph\u01b0\u1eddng)).<\/p>\n<p>On peut donc en conclure que la nouvelle loi sur le logement am\u00e9liore grandement la situation des \u00e9trangers d\u00e9sireux d\u2019acqu\u00e9rir un bien immobilier au Vietnam. Le D\u00e9cret d\u2019application de la loi est en attente de publication mais les projets qui ont circul\u00e9 aupr\u00e8s des acteurs du secteur sont positifs : la volont\u00e9 des autorit\u00e9s d\u2019attirer les financements \u00e9trangers sur le secteur immobilier semble solide.<\/p>\n<p>Il reste \u00e0 voir comment ces directives seront appliqu\u00e9es par les promoteurs, les agents immobiliers, les notaires et les autorit\u00e9s locales en charge de la d\u00e9livrance des certificats de droit d\u2019usage c\u2019est-\u00e0-dire le D\u00e9partement des ressources naturelles et de l\u2019environnement.
