Par contre, le code p\u00e9nal sanctionne express\u00e9ment la violation du secret des correspondances parfois lourdement.<\/p>\n<p>De plus la confidentialit\u00e9 est le seul moyen pour prot\u00e9ger les savoir-faire et les inventions non-brevetables au Vietnam, les entreprises sont donc dans l\u2019obligation de prendre des mesures afin d\u2019assurer cette confidentialit\u00e9. Dans la pratique, les clauses de confidentialit\u00e9 prennent la forme d\u2019un engament sign\u00e9 s\u00e9par\u00e9ment du contrat de travail. Selon le droit Vietnamien, si aucune clause n\u2019a \u00e9t\u00e9 sign\u00e9 et si le r\u00e8glement int\u00e9rieur de l\u2019entreprise ne pr\u00e9voit rien, la responsabilit\u00e9 du salari\u00e9 qui a r\u00e9v\u00e9l\u00e9 des informations confidentielles peut \u00eatre mise en cause seulement si l\u2019employeur r\u00e9ussi \u00e0 prouver un pr\u00e9judice r\u00e9sultant directement de ce fait. Dans le cadre de cette protection l\u2019entreprise peut aussi surveiller ses salari\u00e9s, au travers notamment de logiciels sp\u00e9cialis\u00e9s, dans la mesure o\u00f9 cela ne porte pas atteinte au respect de leurs vies priv\u00e9es.<\/p>\n<p>Enfin, les clauses de confidentialit\u00e9 doivent \u00eatre limit\u00e9es dans le temps et dans l\u2019espace et ne doivent pas emp\u00eacher le salari\u00e9 d\u2019exercer un emploi futur.
